In November 2020, voters in four states decided adults can use marijuana.

Now, cannabis is legal in 15 states. Still, what if you’re in a state where cannabis isn’t legal? What if you’re not an adult?

That is to say, what about CBD oil laws? Here’s all you need to know about CBD in the United States.

CBD Oil Laws on the Federal Level

In late 2018, President Donald Trump passed the Farm Bill. The bill legalized hemp on the federal level, but you need a license to grow it.

How Do CBD Laws Work in the USA?

CBD comes from both hemp and marijuana, two varieties of Cannabis sativa. CBD federal law states that CBD from hemp produced under the Farm Act is legal. Per federal law, another CBD is illegal unless in an FDA-approved pharmaceutical.

State laws on CBD, from both marijuana and hemp, vary. Here’s all you need to know about CBD oil legality.

Alabama: Legal, With Restrictions

In Alabama, adults can use CBD from hemp for anything. You need medical approval to use CBD from marijuana there.

Alaska: Legal All-Around

Marijuana is legal for adults 21+ in Alaska, who can use CBD for anything. It doesn’t matter whether it’s from hemp or marijuana.

Arizona: 100% Legal, in Effect Soon

On November 30, cannabis possession becomes legal in Arizona.

Then, adults can use hemp or marijuana CBD oil for whatever they want.

Arkansas: Legal for Medical Uses

In Arkansas, you must be a patient to use CBD oil from marijuana. Adults can use CBD oil from hemp for anything.

California: Legal, Fullstop

California is another state where cannabis is legal. CBD from any source is legal for use by adults.

Colorado: 100% Legal

Colorado approved of cannabis early on. CBD from both hemp and marijuana is legal for adults there.

Connecticut: CBD From Hemp Is Legal

Any adult can use CBD from hemp in Connecticut. You have to be a medical patient to use marijuana-sourced CBD.

Delaware: From Hemp and for Medical Use

Delaware has restrictions similar to Connecticut. Marijuana CBD is for patients only.

Florida: Hemp CBD and Medical Marijuana

Licensed patients can enjoy marijuana-sourced CBD in Florida. Otherwise, stick to hemp.

Georgia: Hemp and MMJ Again

Hemp CBD is legal for adults in Georgia. Only medical marijuana (MMJ) CBD is legal.

Hawaii: You Guessed It

Hawaii is yet another state with the hemp and MMJ CBD restriction. Marijuana-sourced CBD is illegal otherwise.

Idaho: No Cannabis Allowed

Idaho’s laws are more unique. It’s not good news if you want to use CBD.

Even though CBD oil is legal by federal law, you can’t use it in Idaho.

Illinois: Cannabis Is Legal

Recreational marijuana became legal in Illinois in January 2020. All CBD oil is legal for adults there.

Indiana: No MMJ Option

Hemp CBD is cleared for adults in Indiana. No CBD from marijuana is legal.

Iowa: Hemp and MMJ

In Iowa, CBD from hemp is legal for adults. Iowa reserves marijuana CBD for MMJ patients.

Kansas: Hemp, No Marijuana

CBD is legal in Kansas—from hemp. CBD oil from marijuana isn’t legal for anyone.

Kentucky: No MMJ Here

Kentucky offers no MMJ. You can use CBD from hemp.

Louisiana: Hemp and MMJ CBD

In Louisiana, use CBD oil from hemp if you’re not an MMJ patient. If you are, you can use marijuana CBD oil.

Maine: Legalized All the Way

In Maine, any adult can use marijuana. All kinds of CBD are legal, too.

Maryland: Hemp and MMJ Again

Maryland is another state where marijuana is for medical use alone. Hemp CBD is legal.

Massachusetts: It’s Legal

Marijuana is legal for adults in MA. CBD from hemp and marijuana is, too.

Michigan: Legal Here, Too

Michigan is another state with legal marijuana. All CBD is legal, too.

Minnesota: Hemp CBD and Medical Marijuana

Stick to hemp CBD in Minnesota. That is unless you have an MMJ license.

Mississippi: CBD From Hemp

If you use CBD in Mississippi, make sure it’s from hemp. Marijuana is illegal.

Missouri: Hemp and MMJ

In Missouri, adults can use hemp CBD for anything. MMJ licenses are available.

Montana: Legalized for 2021

MT voted for legal marijuana in November 2020. In January 2021, everyone 21+ can use any CBD.

Nebraska: Another Anomaly

All kinds of cannabis are illegal in Nebraska. As in Idaho, CBD oil is illegal there.

Nevada: 100% Legal

Nevada allows all cannabis. You can use any kind of CBD as an adult.

New Hampshire: Hemp CBD and MMJ

CBD from marijuana is legal for medical use in NH. Otherwise, stick with hemp.

New Jersey: Legal in 2021

Voters approved cannabis in November 2020. In January 2021, all CBD is legal for adults.

New Mexico: MMJ and Hemp CBD

To use marijuana CBD in NM, get an MMJ license. Any adult can use hemp CBD.

New York: Hemp and MMJ

In New York, use marijuana CBD only as a card-carrying patient. Other adults can use hemp CBD oil.

North Carolina: No Marijuana

In NC, stick to hemp CBD. Marijuana is illegal.

North Dakota: MMJ and Hemp CBD

CBD is legal from hemp and as MMJ in ND. Using marijuana CBD otherwise isn’t allowed.

Ohio: Hemp CBD and MMJ

So, is CBD legal in Ohio? From hemp, for 21+ adults. MMJ cardholders can use CBD from marijuana.

Oklahoma: MMJ and Hemp

Oklahoma is another state where you need a license for marijuana CBD. Oklahoma allows hemp for all adults.

Oregon: Legal All-Around

Oregon is another state with legal cannabis. Any CBD is approved for adults.

Pennsylvania: Hemp and MMJ CBD

Pennsylvania allows CBD hemp and MMJ. PA bans other marijuana.

Rhode Island: MMJ and Hemp Both OK

Marijuana is medical-only in RI. Hemp CBD is ok for adults.

South Carolina: No Marijuana Here

Marijuana isn’t allowed in SC. You can use CBD from hemp.

South Dakota: Marijuana Legal Soon

Starting in July 2021, marijuana is OK for all adults. That makes all kinds of CBD legal.

If you qualify, you can get certified for a South Dakota medical marijuana card, allowing you to access medical marijuana much sooner than waiting for the state’s program.

Tennessee: No Marijuana CBD

In TN, marijuana isn’t allowed. CBD from hemp is OK for adults.

Texas: Marijuana Banned

Texas adults can’t use marijuana. Hemp CBD is allowed.

Utah: MMJ and Hemp CBD

In Utah, you need a license to use marijuana. Hemp CBD is legal for adults.

Vermont: Hemp and Marijuana CBD

All kinds of cannabis are legal in Vermont. You have to be an adult.

Virginia: Non-Medical Marijuana Is Banned

Hemp CBD is legal. You can’t use marijuana CBD in VA except as MMJ.

Washington: It’s Legal

Cannabis is legal in Washington. Adults can use any CBD.

Washington, DC: Legal Here, Too

DC isn’t a state but has its own laws. All cannabis—and all CBD—is legal.

West Virginia: MMJ and Hemp CBD

WV has an MMJ program. Hemp CBD is OK for all adults.

Wisconsin: Hemp and MMJ Again

Wisconsin allows MMJ, too. Everyone else: Stick to hemp CBD.

Wyoming: MMJ and Hemp CBD

Last but not least, Wyoming. The state allows MMJ and hemp CBD.
