Is CBD legal? Yes, but not everywhere. As such, it’s your right to know where CBD is legal vs. illegal.

Green States

CBD is legal in all “green states,” which are states that have legalized marijuana. It’s safer to purchase CBD from green states because it’s more regulated. It’s also smarter because you get a better bang for your buck.

Gray States

Gray states are states where CBD is a gray area. State laws sometimes conflict with federal laws here. Congress passed a bill to legalize hemp, but this conflict means you’ll have more research to do.

Keep in mind that even legal states have some restrictions. For instance, CBD is legal in Maine and Vermont, but there are still some restrictions due to regulation.

The following states are also gray states and have restrictions regarding CBD: Minnesota, Mississippi, Connecticut, Nebraska, Florida, Delaware, Idaho, Arkansas, New Hampshire, Pennsylvania, Virginia, and Washington.

Where is CBD Illegal? 

In Iowa and Idaho, CBD is illegal in every form. Never attempt to buy or ship CBD to an Iowa or Idaho residence until CBD laws improve.

South Dakota was also a red zone state for a while. Since then, they’ve pushed for green-friendly legislation that allows the sale of FDA-approved CBD products.

An important study concluded that out of all the CBD products researchers analyzed, only 31% of the CBD products contained the amount of CBD their labels claimed to have. That’s why it’s safer to buy from green states where CBD is more regulated.

So where is CBD legal? It’s legal in all of the green states, but even then, it might not be legal in all forms. Again, learning about your local CBD laws is the only way to know for sure if any restrictions apply to you.
